Welcome to Vital Insights. By accessing our website or engaging our business and/or life coaching services, you agree to these Terms & Conditions. Please read them carefully.
1. Services Overview
Vital Insights provides specialised business consulting and life/clarity coaching delivered via one-off sessions and subscription plans. We offer practical guidance for strategy, systems, decision-making and personal effectiveness. Implementation and outcomes remain your responsibility.
We do not provide medical, psychological, legal or financial advice. Coaching is distinct from therapy or clinical services. If clinical or legal matters arise, we’ll recommend you seek a registered professional.
2. Coaching Scope & Exclusions (Important)
2.1 Scope. Coaching supports clarity, planning, accountability and behaviour change related to work and life goals.
2.2 Exclusions. Coaching is not health, mental-health, legal, investment, accounting or other regulated professional advice. We do not diagnose, treat, or prevent medical or psychological conditions and do not hold ourselves out as registered health practitioners.
2.3 Referrals. If issues emerge that are better served by clinical or regulated professionals, we may pause or decline services and suggest appropriate referrals.
2.4 Crisis/Emergency. We are not a crisis service. If you are in immediate danger, call 000 (Australia) or your local emergency number.
3. Financial Terms
3.1 Payments. All services are payable at booking (AUD) via secure third-party processors unless otherwise agreed in writing.
3.2 Subscriptions. Subscriptions may be billed monthly or by instalment. You may cancel at any time; no further charges will occur after cancellation.
3.3 Refunds. We generally do not provide pro-rated refunds for unused portions of pre-paid packages, except where required by law or at our discretion. Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).
4. Appointment Management
4.1 Rescheduling. You may reschedule with ≥24 hours’ notice via our booking system. <24 hours’ notice or no-shows are forfeited and non-refundable.
4.2 Provider reschedule. We may reschedule for illness or unavoidable events and will give as much notice as possible; you won’t be charged for any session we cancel.
5. Confidentiality & Privacy
5.1 Confidentiality. We keep your information confidential and will not disclose it without consent, except where required by law or necessary to prevent imminent harm.
5.2 Privacy & Health Information. If sessions touch on wellbeing or mental health, any notes that amount to health information will be handled with extra care. We aim to collect minimal data, store it securely, and retain it only as long as necessary.
5.3 Privacy Policy. Our Privacy Policy explains what we collect, how we use it, storage, access/correction requests, and complaints. By using our services you agree to those practices.
6. Recordings & Materials
6.1 Session recordings. Sessions are not recorded unless we both agree in writing beforehand. If recorded, you will be told the purpose, storage, and retention; you may withdraw consent at any time.
6.2 Client materials. You warrant that any materials you provide do not infringe third-party rights and that you have authority to share them.
7. Intellectual Property
7.1 Ownership. Our frameworks, templates, methods and documents remain the intellectual property of Vital Insights unless we agree otherwise in writing.
7.2 Licence. We grant you a non-exclusive licence to use deliverables internally within your business. Republishing, selling, or sharing outside your organisation requires our prior written consent.
8. Communication & Marketing
8.1 Operational messages. By engaging our services, you consent to receive operational communications (confirmations, reminders, follow-ups).
8.2 Marketing messages. We may send occasional updates about services or resources. You can unsubscribe at any time and we will honour the request. We do not sell your details to third-party marketers.
8.3 Testimonials. If you provide feedback, we may request permission to publish it with minimal identifiers (e.g., first name and business). You may refuse or revoke permission.
9. Client Responsibilities
Provide accurate information, participate actively, and exercise independent judgment when implementing recommendations. You remain responsible for decisions and results.
10. Limitation of Liability
10.1 No guarantees. Results vary by client and context. We cannot guarantee specific outcomes.
10.2 Limits. To the maximum extent permitted by law, Vital Insights is not liable for indirect or consequential loss (including lost profits or opportunities). Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the ACL.
11. Third-Party Tools & Platforms
We may recommend or use third-party software (e.g., scheduling, video, payment, AI tools). Those tools are governed by their own terms and privacy policies. You’re responsible for reviewing and using them appropriately.
12. Minors
Our services are intended for adults. Coaching for persons under 18 requires parent/guardian consent and may be declined at our discretion.
13. Complaints & Refund Process
If you’re dissatisfied, contact support@vitalinsights.com.au within 14 days of the session with details of the issue. We’ll work with you in good faith—this may include a re-do session, partial credit, or refund where appropriate and/or required by the ACL.
14. Updates to Terms
We may update these Terms to reflect legal or operational changes. The “Last Updated” date will change and material updates may be notified on-site or via email. Continued use after updates constitutes acceptance.
15. Legal Framework
These terms and any disputes arising from our services shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles.
Should any provision within these Terms be deemed invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed while remaining provisions retain full effect. By accepting these terms, you agree that any legal proceedings related to our services shall be adjudicated in Queensland courts (unless both parties consent to alternative dispute resolution).

Given the unique nature of each business, we cannot provide absolute outcome guarantees. Clients retain sole responsibility for their business decisions and subsequent actions following our consultations.
